 What has help my family is to make plans before hand. My husband's family has sat down with his mother and other siblings.  They had a meeting as a family. Then my mother in law put her wishes in writing (with some help) and every one has a copy of her wishes. This included who was the Power of Attorney, Executor of state, who gets the house, Funeral arrangements, insurance policies. etc. ... I do think that every family should do this . I work in the health care field and many families fight because there is no advance planning . The patient suffers because there is no Health Care Power of Attorney to advocate for the patient. So, the same goes with Estate issues. Plan before tragedy strikes. Communication is essential. (Proverbs 15:22)

susan it is a nightmare, and all I can tell you is if you were not married at the time your loved one passed you do not stand a chance next of kind is his family sorry to say but I have a story that I will share with you later but not now. Good luck Kenyada

Anita, Texas does recognize common-law marriage. It must be proven within one year of the end of the relationship (either separation or death). You should definitely contact an attorney or legal services to help you! I wish you the best. It is hard enough to lose your fiance, as I did June 20, 2009, and it makes it even harder when his family is so inconsiderate. Please keep us updated.

My name is Anita and on Oct 26th my fiance died in a horrible plane crash in Texas. We were days from getting a will taken care and now I've lost everything. We lived together for 3 yrs and during that time we established a home and property. All in Malcolms name. The family knows his wishes but aren't going to follow them. I'm David in the story of David and Gallieth. I'm battling a very wealthy family who never really knew me and could care less about me. His brother knew of us and knows his wishes yet he too will not follow Malcolms wishes. People tell me I have a slim chance of maybe getting the concideration in his estate cause we had bank accounts togehter, power of attoney wish his insurance company, credit cards together and lived togehter. I can't afford an attorney so I need to write the probate courts myself. I don't know how to do that. Can anyone help me save my home possibly and help me write this letter.
